According to the ruling of the Barcelona District Court on March 15, 2014, it has been determined that the current timeframe for claiming a refund of amounts has already expired, as consumers became aware of the abusive nature of BBVA's expense clause in January 2017.

The period for requesting the reimbursement of expenses resulting from an abusive clause, as per the Court of Justice of the European Union ("CJEU") must be taken into account from the time the person concerned becomes aware of the abusive nature of the clause in question.

In relation to the BBVA expenses clause, it was declared abusive by the Supreme Court in a ruling dated December 23, 2015. The ruling, released on January 21, 2016, garnered widespread attention in the ensuing months, reaching not only professional circles but also consumers and featuring prominently in various publications, communications, advertising, and news outlets. Therefore, it should be understood that as of January 2017 the circumstances that allow the computation of the limitation period for claiming the return of expenses can be considered fulfilled (as established by the recent judgment of the Barcelona District Court when applying the criterion of the last judgment of the CJEU).

Thus, as the period for requesting a refund of the amount is, as per the current law, five years, the deadline for requesting this refund has long since expired.
